2.Your data protection rights
In connection with the processing of personal data by Linde, all data subjects have the following rights under- Right to information;
- Right to rectification;
- Right to erasure;
- Right to restriction of processing;
- Right to data portability;
- Right to object.
If you believe that Linde's processing of personal data does not comply with data protection regulations or if you are not satisfied with the information we provide, you have the right to lodge a complaint with the competent supervisory authority.
3. Transfers to third countries or international organisations
We make sure that your data is not transmitted to recipients in countries without an adequate level of data protection (third countries). In some cases, however, this cannot be avoided completely. Where this is the case, Linde has taken and will continue to take appropriate measures to ensure an adequate level of data protection for the recipient at all times.4. Storage and retention periods
We process personal data only for as long as it is necessary to fulfil our contractual obligations. As soon as the data in question is no longer needed, it is usually deleted.However, in order to comply with certain legal requirements, we need to retain some data beyond the termination of the contractual relationship. This includes commercial and tax documentation, verification and retention obligations. In these cases, we are usually obliged to keep the data for ten years.
II. Processing of personal data by Linde for core business purposes
1. Type and origin of personal data processed by Linde
We process personal data only to the extent necessary to fulfil our contractual and legal obligations in connection with the business relationship with our customers, suppliers and partners. "Processing" means that we collect, store, delete or transfer personal data, to name just a few examples.The personal data we process includes:
- Master and contact details of customers and suppliers, such as name, address, telephone number, e-mail address, function, department of our contact persons, etc.
- Data that we need for invoicing and payment processing, such as bank details, tax number, credit management information, etc., to the extent that it is data of a natural person;
- Information on supplier and customer relationship management, such as order history, etc., insofar as it concerns data of a natural person;
In some cases, we also process personal data obtained through other means, in accordance with applicable data protection laws. This is usually the case for:
- Publicly accessible sources, e.g. commercial and company registers, trade fairs, exhibitions, internet sources, newspapers, business directories, etc.
- Third parties that are not affiliated with Linde, e.g. trade associations, credit agencies, insurance companies, etc.
2. Purpose of processing by Linde and legal basis
We process your personal data only for permitted purposes and in accordance with the applicable legal provisions of data protection laws.2.1 We process data to fulfil our contractual obligations.
We process personal data for the fulfilment of our contractual obligations towards our customers and suppliers or for the implementation of so-called pre-contractual measures, which are carried out in response to a specific request.In these cases, the purpose of the data processing is determined by the contract we have concluded with our customer or supplier and the services that must be provided under this contract. This includes, for example, the processing of personal data in the context of sending catalogues, information about our services or the preparation of specific offers.
2.2 We process data for the protection of legitimate interests
In addition, we process personal data to the extent necessary to safeguard the legitimate interests of Linde or Linde's companies as well as our customers (and other third parties, if applicable). In this case, we process personal data only taking into account your interests.In detail, these include, for example:
- The supply of products and services
- Customer service and complaint handling
- Direct marketing, provided that you have not objected to the processing of your personal data for these purposes
- Surveillance of publicly accessible rooms in our branches with optical-electronic equipment (video surveillance)
- The transfer of personal data within Linde for internal administrative purposes
2.3 We process data with your consent
We process your personal data even if you have given us your consent. You can withdraw your consent at any time. Please note, however, that data processing remains permissible until the time of revocation.2.4 We process data to comply with legal obligations
We are required to process certain data in order to comply with legal obligations. Such obligations may arise from certain provisions of national economic, commercial, tax and social law as well as international legislation, e.g. in connection with regulations on the prevention of terrorist financing. This may also result in individual obligations for Linde to secure, store, report and collect data, which usually serve the control purposes of the respective authorities.2.5 Information on the Change of Purpose
Should we process your personal data for a reason other than that for which we originally collected it, we will only do so to the extent permitted by law and inform you of this new purpose.3. Recipients of your data
Personal data will only be made available to other companies by Linde if and to the extent necessary to protect our legal and contractual rights and obligations. This may be the case, for example, in the coordination of our contractual services. Typical examples are central supplier and customer management services, central IT services and internal shared service centers in finance and accounting.In order to fulfil certain contractual obligations, we work together with external service providers. This is the case, for example, in connection with specific supplier and customer management services, the hosting of IT infrastructure and an external shared service center in finance and accounting, payment processing (credit card, direct debit, purchase on account), logistics and delivery, promotions or the processing of online orders. Insofar as we involve external service providers, this is always done within the framework of the legal provisions and in compliance with the applicable data protection regulations.
We only pass on personal data to other recipients outside Linde if we are legally obliged or entitled to do so. In all other cases, we will only share your data with other third parties if you have given us your consent to do so.
As part of the continuous development of our business, we may sell subsidiaries or parts of our business or merge our business or parts of it with another company. Such transactions typically involve the transfer of customer information about the sold or divested subsidiary or part of the company to the buyer or the company created by the merger. Also, in the unlikely event of a sale of all or substantially all of Linde, your personal data will be disclosed to the buyer.
4. Obligation to provide data
In order to provide our services to our customers, we need to process certain personal data or are required to do so by law. When concluding the contract, we collect the relevant data from you (e.g. address, business contact details and function).Without this data, we cannot conclude contracts with our customers.
5. Automated decision-making and profiling
We do not use automated decision-making processes for procedures that have legal effects or similarly significant effects for you. No decision is made without further human verification. Profiling within the meaning under the applicable data protection laws does not take place at Linde. In exceptional cases, we will provide a separate privacy policy.III. - Measures to provide website functionalities such as user account management, shopping carts.
2.3 We process data with your consent

On our websites, we only use so-called tracking pixels with your express consent.Through the tracking used on our websites, contacts that you have with advertisements on other websites (visual contacts and clicks on advertising banners) or with our e-mails are related to interactions on our website.
The collected data is compiled and evaluated for the purpose of optimising and economically operating our online offer, our website, and e-mail communication as well as for determining the effectiveness of marketing campaigns (taking into account whether you are already an existing customer outside our online offer)

For the technical implementation, we work with the following service providers: Google Analytics, a web analysis service, and Google Optimize, which is operated and provided by Google Inc. (1600 Amphitheatre Parkway, Mountain View, CA 94043, United States). If you are habitually resident in the European Economic Area or Switzerland, Google Ireland Limited (Gordon House, Barrow Street, Dublin 4, Ireland) is the controller responsible for your data. We use Google Analytics to analyze website usage. The data obtained from this is used to optimize our website and advertising measures. This data is transmitted to a Google server in the USA and stored. Google as well as government authorities have access to this data and it is also used by Google for its purposes, such as profiling and merging it with other data about you. For this purpose, your data such as search history, personal accounts (e.g. user ID or email address), usage data of other devices and all other data that Google has about you is linked. In addition, we use the data collected by Google Analytics as part of Google's Optimize tool. Together with an additional cookie, Optimize allows us to test different versions of a website and how users react to those different versions. For example, we can test where within the website a certain piece of information is most attractive (A/B testing). The additional cookie is used to determine whether you are taking part in a test and determines the end of the test.
